We are pleased to announce that Amy C. Stewart has been promoted to partner and Alexis P. Theriault has become associated with the firm. Ms. Stewart joined the firm in 2002 after earning her J.D. from Boston University School of Law. She will continue to focus her civil litigation practice in the areas of construction law, employment law, professional liability and business litigation. Ms. Theriault joined the firm in 2011 after earning her J.D., summa cum laude, from Suffolk University Law School. She will concentrate her practice in civil litigation. |

James Gray Wagner and Erin D. Wolf secured a jury verdict in Middlesex Superior Court on a claim of Misappropriation of Trade Secrets between competing medical device companies. The case now requires the judge to decide additional remedies under claims for Chapter 93A violation and injunctive relief for return of the client's intellectual property. |

Mr. Peisch and Ms. Higgins regularly advise lawyers and law firms on ethical issues. |

Thomas E. Peisch has been appointed by the Massachusetts Board of Bar Overseers to serve as Special Hearing Officer in a disciplinary matter involving two attorneys. Mr. Peisch will hear and consider the evidence and make a recommendation to the Board regarding whether any disciplinary action is warranted. Mr. Peisch was a member of the Board from 2001- 2004, and was its Vice-Chair from 2003 - 2004. |

A team of Conn Kavanaugh attorneys volunteered for the Discovering Justice Program, Stand Up for Your Rights, that culminated in a mock argument at the Supreme Judicial Court before Justice Robert J. Cordy. Stand Up for Your Rights is an interactive after school program that teaches underserved Boston middle school students about the Bill of Rights through an in-depth study of the Fourth Amendment. For the culminating event, students participate in a mock appellate argument at the John Adams Courthouse before a judge. The Conn Kavanaugh team included Carol A. Starkey, Amy C. Stewart, Gregory M. Boucher, Erin Desmarais Wolf, Jacqueline Giordano-Hayes, and Jan M. Kendrick. |

Thomas E. Peisch was quoted in a front-page Massachusetts Lawyers Weekly article discussing a large plaintiff's verdict in a workplace injury case. Mr. Peisch, a past President of the Massachusetts Defense Lawyers Association, attributed the large award to the amount of the special damages in the case and pointed out that burn victims like the plaintiff in the case under discussion frequently are very appealing to juries. |

Gannon to participate in the 2011-2012 Women's Leadership Initiative, a program that provides mentoring and leadership development to women attorneys in Massachusetts who have been identified as the rising stars of the profession. Erin K. Higgins has been elected to the Board of Directors of the Massachusetts Appleseed Center for Law and Justice. Massachusetts Appleseed works to develop innovative and collaborative solutions to pressing social justice issues. Current projects include Keep Kids in Class, which seeks to keep children out of the "school to prison" pipeline and on track to graduate from high school. |

Possibly, Strict Liability as an Apparent Manufacturer, ” appears in the July 2011 edition of Defense Counsel Journal, a quarterly publication of the International Association of Defense Counsel. The article discusses recent case law holding a trademark licensor strictly liable for product defects if the licensor participated substantially in the design, manufacture, or distribution of the licensed products. |

A federal magistrate judge issued a 52-page decision exonerating the firm's client, a lawyer, of alleged misconduct in connection with an investigation by the SEC. The judge not only rejected the SEC's request for sanctions, but went on to find that the lawyer's conduct was "unimpeachable" and "self-sacrificing and responsible." The matter was handled by Thomas E. Peisch and Erin K. Higgins of the firm's regulatory practice professional liability group. |
