Thomas E. Peisch was quoted by the Christian Science Monitor in an article entitled "Madoff Scam Saps Confidence in Wall Street." Mr. Peisch discussed the watchdog role of the Securities and Exchange Commission relative to investors' loss of over $50 billion and fund manager Bernard Madoff. Responding to the allegation that the agency disregarded information regarding Madoff’s fraudulent dealings, Mr. Peisch suggested that while the Securities and Exchange Commission receives numerous complaints, “If it is true they received substantive complaints and blew them off, they will face some heavy sledding.”

The Delaware Supreme Court provided Russell F. Conn, James Gray Wagner, and Andrew R. Dennington a major victory for our client, affirming after oral argument a favorable judgment obtained in the Delaware Chancery Court in defending a $7MM claim brought by Lloyd's of London against the firm's client, a Maryland insurance broker.

Conn Kavanaugh's firm administrator Elizabeth Ounanian was selected and celebrated as the Best Firm Administrator at the Massachusetts Lawyers Weekly Unsung Heroes award luncheon. Unsung Heroes are administrative personnel who demonstrate outstanding qualities in the workplace; they go above and beyond the call of duty to build pride within a firm or company.

An article authored by Thomas E. Peisch entitled A Word to the Wise about Payment to Experts was published in the October 20, 2008 edition of Massachusetts Lawyers Weekly. The article examines the payment of hidden contingent compensation to expert witnesses by the New York-based Milberg Weiss law firm, summarizes the applicable legal authority, and points out practice pitfalls for Massachusetts lawyers who retain expert witnesses.

James B. Peloquin spoke at the MCLE's “Standard Form Construction Contract Documents” seminar. The 2007 American Institute of Architects' changes to traditional construction agreements were introduced, along with the newly created ConsensusDOCS 2007, which provides a consensus set of contract documents and is endorsed by the Associated General Contractors and affiliated trade groups.

George M. Ford has been selected by his peers to be in the upcoming 2009 edition of the Best Lawyers in America, in his specialty of Family Law. This marks the 26th year that Mr. Ford has been listed in the publication. Inclusion in Best Lawyers is based on a rigorous peer-review survey conducted annually by the publishers of the book since its 1983 inception. This is a distinctive honor, as the publication is considered by many in the legal profession and general public as the most respected referral list of attorneys in practice.

Following a three-week jury trial in Suffolk Superior Court, James B. Peloquin and Erin K. Higgins obtained a defense verdict for the firm's client, an electrical subcontractor, in a case brought by two tunnel workers injured in a construction shaft. The jury deliberated for only two hours before returning the verdict, finding that the firm's client had not been negligent in its installation or maintenance of communications equipment inside the shaft.

As part of the firm’s 20th anniversary celebration, Conn Kavanaugh volunteered at the Greater Boston Food Bank to inspect, sort and repack food and grocery products, which are then redistributed to over 600 hunger-relief agencies throughout eastern Massachusetts.  The CKRPF group sorted a total of 7492 pounds of food and made possible 5676 meals for local families.See Photos.

Health Law Advocates, a non-profit law firm dedicated exclusively to health care access, named Andrew R. Dennington its Attorney of the Month. In its August newsletter, HLA stated that Mr. Dennington " epitomizes the extraordinary contributions of the many new members of the Legal Network."  Mr. Dennington has successfully represented uninsured patients who have incurred significant medical debt during treatment for catastrophic medical events.

Kurt B. Fliegauf, defending a case brought against our clients pursuant to the state’s independent contractor statute, successfully obtained an order denying class action certification. The issue of whether a defendant affirmatively could file a motion to deny class action certification previously had not been considered by the Massachusetts courts. Massachusetts Lawyers Weekly ran a front page story on August 11, 2008 on the decision titled “Defense Tactic Clears Way for a Major Victory in Class Action.”

The Massachusetts Supreme Judicial Court issued a decision today affirming the Land Court's ruling upholding the validity of Brookline's Floor-to-Area Ratio zoning. James Gray Wagner submitted an amicus brief supporting Brookline's position on behalf of the City Solicitors and Town Counsel Association.

After trial, Michael T. Sullivan obtained a plaintiff's verdict in Massachusetts Superior Court on behalf of our client, a commercial property owner. The owner was awarded money damages, including reimbursement of legal fees, based upon the defendant-tenant's breach of the parties' lease and improper use of the owner's property.
 
July 1, 2008
Russell F. Conn and Lurleen A. Gannon obtained a jury verdict for their clients in the Middlesex Superior Court on a fraud and deceptive practices claim. After a four day trial and seventy-five minute deliberation, the jury awarded damages in the full amount sought and then doubled the award under the Massachusetts Consumer Protection Act. The trial court since has awarded attorneys' fees and costs and denied the defendant's post-trial motion to set aside the jury's verdict. The full judgment is for approximately $300,000.

Russell F. Conn has been selected again by Chambers USA as one of "America's Leading Lawyers for Business." As in 2007, Mr. Conn was noted specifically for his practice in the Labor and Employment field.

The Massachusetts Appeals Court affirmed favorable trial court rulings for our client on the issues of Employee Retirement Income Security Act (ERISA) preemption and the meaning of a Change of Control Agreement with his former employer. The rulings entitle our client to retiree health benefits at frozen contribution levels and damages. Constance M. McGrane handled the trial court motions and appeal.

Kurt B. Fliegauf obtained a defense verdict after a jury trial in favor of our clients, a national real estate agency and one of its individual agents, in a professional liability case.  The jury deliberated for less than one-half hour before reaching its verdict.
 
June 20, 2008
Ronald M. Jacobs obtained a plaintiff's verdict after a two-week jury trial.  The jury awarded our client in excess of $1.2 million on his claims against his former employer, a real estate developer, for the share of the profits that he had been promised verbally.
