Thomas E. Peisch addressed a group of judges at a judicial conference on the subject of evaluating tort and other damages in Massachusetts. His talk featured a discussion of recent developments in the law and some suggestions for judicial practice in light of them. |

Thomas J. Gallitano recently served on the faculty of a Massachusetts Bar Association seminar entitled It's Confidential - Privilege Law in Massachusetts. Mr. Gallitano spoke on the application of the so-called Common Interest and Joint Defense Doctrines under Massachusetts law, with particular emphasis on how those doctrines relate to the attorney-client privilege, and on the circumstances under which those doctrines can be defeated to require an adversary in litigation to turn over documents that might otherwise be protected from discovery because of the attorney-client privilege. |

Neil R. Schauer, and his son Cory, have been selected as 2006 Community Heroes by the Jewish Family Service of the North Shore. Neil is currently on the Board of Directors and Executive Committee of the Jewish Federation of the North Shore. He also served on the Board of Trustees and as Vice President of Temple Emmanuel in Marblehead. His contributions to the North Shore community also include membership on the Board of Directors and Finance Committee of the North Shore Jewish Community Center. In addition, he has been active in fund raising for various North Shore charitable organizations. He and his son will be formally honored at an event on May 10, 2006 at Congregation Shirat Hayam in Swampscott. |

James F. Kavanaugh, Jr. was quoted in the Boston Business Journal (March 17-23) in an article entitled "Bay State bill takes on frivolous consumer lawsuits." The article concerns a bill sponsored by Associated Industries of Massachusetts which would require plaintiffs to prove they suffered actual monetary damages for a M.G.L. c. 93A suit, and bar class action lawsuits based on consumer protection violations. Mr. Kavanaugh pointed out that Hershenow v. Enterprise Rent-A-Car Co. of Boston, a case decided in January 2006 by the Supreme Judicial Court of Massachusetts, highlights the damages issue. |

Russell F. Conn and Johanna L Matloff obtained a defense verdict for their client, a subsidiary of a Fortune 500 company, from a Norfolk Superior Court jury following a one week trial. Plaintiff subrogated insurance company had sought recovery of approximately $250,000 for a property damage loss at a construction site. The jury deliberated one hour and returned responses to special verdict questions by a 13-0 vote in favor of the firm's client. Judgment then entered dismissing the claim and awarding the defendant its costs. |

Residential Construction Advocacy Seminar. Three of Conn Kavanaugh's partners were instructors at a Massachusetts Continuing Legal Education seminar entitled Residential Construction Advocacy. James Gray Wagner, a member of the firm's Land Use group, presented on advocacy before local zoning boards and in Land Court. Michael Sullivan provided information for the civil litigation arena based upon his experience in handling cases for plaintiffs and defendants in real estate and construction matters. Connie McGrane, a member of the firm's Construction Law group, chaired the seminar. |

Russell F. Conn and Michael R. Bernardo obtained summary judgment for their client, a senior executive from a major Boston personnel agency, reforming the non-competition obligations in the executive's employment agreement by reducing the restrictive period from five years to eighteen months. The judgment was issued by Judge van Gestel of the Suffolk County Business Litigation section following expedited discovery on a complaint for declaratory judgment. |

George Ford moderated the Family Court Judicial Forum of 2005 sponsored by Massachusetts Continuing Legal Education, Inc. (MCLE) in November and December. The forum consists of four panels of Probate and Family Court Justices from nine different counties, who analyze hypothetical fact patterns designed by the moderators. This year marks Ford's 28th year as moderator of this invaluable forum, which provides participants insight into how particular justices will decide current issues in domestic relations cases. |

Michael T. Sullivan obtained a plaintiff's verdict in Superior Court on behalf of a commercial property landlord. The verdict declared a tenant of the landlord to be in breach of the parties' lease after having caused significant damage to the property. The tenant will now be required to reimburse the landlord's legal fees and either restore the property to its original condition or pay money damages that would allow the landlord to do so. |

James B. Peloquin recently spoke at the Massachusetts Bar Association seminar on Public Construction Reform-One Year Later. The seminar focused on sweeping legislative changes in July 2004, and their ongoing impact in the public construction sector. The discussion included curative legislation presently pending in order to correct and/or further amend the reform act of Chapter 193. Mr. Peloquin is the chairperson of the firm's public construction group. |
