James B. Peloquin was quoted in the March 27, 2006 edition of the Massachusetts Lawyers Weekly in an article entitled "Deal or no deal-Lawyers weigh in on settlement vs. trial." He highlighted the importance of an early assessment of each case, including the cost of litigation and the likelihood of success.

James F. Kavanaugh, Jr. was quoted in the Boston Business Journal (March 17-23) in an article entitled "Bay State bill takes on frivolous consumer lawsuits." The article concerns a bill sponsored by Associated Industries of Massachusetts which would require plaintiffs to prove they suffered actual monetary damages for a M.G.L. c. 93A suit, and bar class action lawsuits based on consumer protection violations. Mr. Kavanaugh pointed out that Hershenow v. Enterprise Rent-A-Car Co. of Boston, a case decided in January 2006 by the Supreme Judicial Court of Massachusetts, highlights the damages issue.

Russell F. Conn and Johanna L Matloff obtained a defense verdict for their client, a subsidiary of a Fortune 500 company, from a Norfolk Superior Court jury following a one week trial. Plaintiff subrogated insurance company had sought recovery of approximately $250,000 for a property damage loss at a construction site. The jury deliberated one hour and returned responses to special verdict questions by a 13-0 vote in favor of the firm's client. Judgment then entered dismissing the claim and awarding the defendant its costs.

Residential Construction Advocacy Seminar. Three of Conn Kavanaugh's partners were instructors at a Massachusetts Continuing Legal Education seminar entitled Residential Construction Advocacy. James Gray Wagner, a member of the firm's Land Use group, presented on advocacy before local zoning boards and in Land Court. Michael Sullivan provided information for the civil litigation arena based upon his experience in handling cases for plaintiffs and defendants in real estate and construction matters. Connie McGrane, a member of the firm's Construction Law group, chaired the seminar.

Russell F. Conn and Michael R. Bernardo obtained summary judgment for their client, a senior executive from a major Boston personnel agency, reforming the non-competition obligations in the executive's employment agreement by reducing the restrictive period from five years to eighteen months. The judgment was issued by Judge van Gestel of the Suffolk County Business Litigation section following expedited discovery on a complaint for declaratory judgment.

Peisch, partner at CKRP&F, was quoted in the March, 2006 edition of CFO Magazine in an article regarding the U.S. Chamber of Commerce's report and recommendations about the demise of Arthur Anderson. He pointed out the need for changes to protect auditing firms from destruction due to isolated bad acts.

Jim Peloquin spoke before the Boston Association of Structural Engineers. The subject of Jim's talk was Massachusetts construction reform and the new requirement of an independent owner's project manager for vertical construction projects in excess of $1.5 million.

George Ford moderated the Family Court Judicial Forum of 2005 sponsored by Massachusetts Continuing Legal Education, Inc. (MCLE) in November and December. The forum consists of four panels of Probate and Family Court Justices from nine different counties, who analyze hypothetical fact patterns designed by the moderators. This year marks Ford's 28th year as moderator of this invaluable forum, which provides participants insight into how particular justices will decide current issues in domestic relations cases.

Michael T. Sullivan obtained a plaintiff's verdict in Superior Court on behalf of a commercial property landlord. The verdict declared a tenant of the landlord to be in breach of the parties' lease after having caused significant damage to the property. The tenant will now be required to reimburse the landlord's legal fees and either restore the property to its original condition or pay money damages that would allow the landlord to do so.

James B. Peloquin recently spoke at the Massachusetts Bar Association seminar on Public Construction Reform-One Year Later. The seminar focused on sweeping legislative changes in July 2004, and their ongoing impact in the public construction sector. The discussion included curative legislation presently pending in order to correct and/or further amend the reform act of Chapter 193. Mr. Peloquin is the chairperson of the firm's public construction group.

Erin K. Higgins has been appointed to the Education Committee of the Boston Bar Association. The Committee is responsible for overseeing and implementing all of the Boston Bar Association's legal education programming.

James B. Peloquin and Erin K. Higgins secured a two part victory in the prosecution of a collection claim on behalf of a law firm, and the defense of the law firm's former client's legal malpractice claim. The malpractice claim was dismissed as a matter of law on summary judgment. The collection claim proceeded to trial, at which time the law firm was awarded a default judgment in its favor as a sanction for repeated discovery abuse by the former client, including the client's failure to comply with an order mandating the exchange of trial exhibits.

Russell F. Conn and Amy C. Stewart obtained a plaintiff's verdict for their client, a prominent local structural engineering firm, from a Suffolk Superior Court jury following a one week trial. The client had sought recovery of significant professional fees and faced a counterclaim for malpractice relating to the design and construction of a Stop & Shop superstore in Woburn. The jury deliberated approximately one hour and returned responses to special verdict questions unanimously awarding the firm's client the full amount owed, to the penny, while rejecting the counterclaim. Defendant paid the full amount of the verdict, plus interest and costs.

James Gray Wagner, Constance McGrane and Ronald Jacobs acted as Panelists and Faculty Critics in the MCLE seminar, Taking Deposition Workshops, coaching and evaluating the deposition techniques of participating lawyers.
