Very often in the course of a construction project, issues arise over workmanship, design quality, and changes to the plans and specifications. Our litigation experience includes claims for delays, differing site conditions, cost overruns, and claims in which work is alleged not to have met the project plans and specifications. We are experienced at finding and working with appropriate technical experts to advance or defend such matters. While settlement is often the most cost-effective resolution, when necessary we have engaged in extensive trials and arbitrations with consistently successful results.

Representative Matters

  • The firm represented one of the largest cities in Massachusetts in an action arising out of claims for defects and delays in the construction of an elementary school. The firm obtained summary judgment dismissing the contractor's counterclaims for several million dollars in change orders, cost overruns, delay damages and lost profits.

  • Representing the owners/developers of a high-rise condominium project outside of Boston, the firm obtained a seven-figure settlement for the client after 25 days before an arbitration panel presenting claims that hundreds of windows were defectively designed, manufactured and installed.

  • Representing a prominent design engineer, the firm obtained summary judgment dismissing all claims brought by a subcontractor for negligence, misrepresentation, and unfair and deceptive trade practices.

  • The firm represented a condominium association alleging building defects and code violations by the project developer and general contractor. Following a favorable jury verdict, the client was awarded double damages and attorney fees pursuant to Chapter 93A.

  • The firm successfully represented the largest town in Massachusetts in two related bid protests concerning interpretation of public construction statutes that were filed with the Office of the Attorney General.

  • The firm provides ongoing advice and contract review to a school building committee charged with overseeing the nearly $100 million dollar renovation and addition to a large high school.

  • The firm was successful in obtaining an injunction in Superior Court against a municipality's going forward with a multi-million contract in view of the municipality's failure to adhere strictly to the requirements of the bidding laws. On the rebid, the firm's client obtained the contract award.

  • The firm has frequently been called upon to represent developer/contractors to respond to condominium owner class actions and trustee claims for construction defects.

  • The firm represented a town in a dispute and subsequent litigation with a subcontractor for work performed on an elementary school. The school re-opened on time and all claims were settled.
