We have assisted contractors in the development of safety manuals that can satisfy OSHA and state requirements. Also, we have experience working with clients during OSHA investigations in the immediate aftermath of construction site accidents, so that their rights are protected during this administrative phase, as well as in a later personal injury lawsuit.

Representative Matter

  • The firm obtained a defense verdict absolving a commercial painting subcontractor of any responsibility for a claim of permanent and total disability brought by an employee who sustained serious injury at a project site.

  • Representing the general contractor, through its insurer, the firm negotiated a mediated settlement in which the subcontractor paid $2 million to the plaintiff, the general paid nothing, and the insurer was reimbursed its attorneys fees and costs.

  • The firm successfully defended a prominent Boston engineering firm in a malpractice action arising out of the collapse of a public building. After prevailing in an evidentiary hearing against the plaintiff for its expert's spoliation of key evidence, and winning several key pre-trial motions, the firm settled the case after the first day of trial on a nuisance basis.
