Public Construction

For years Conn Kavanaugh has been engaged as special counsel to towns, cities, and government agencies. Massachusetts has a complex maze of statutory requirements that are unique to the public bidding and construction process. Often, cities and towns will look to Conn Kavanaugh to enhance their expertise in this area for substantial public projects like schools, libraries, public safety facilities, and horizontal construction projects like storm and sewer systems. We also have represented clients pursuing claims against public authorities, including bid protests and claims for contract balances and additional compensation.

Contract Drafting and Negotiation

The key to avoiding construction litigation begins with appropriate contract documents. While many in the construction arena are accustomed to using standardized forms, these are fraught with pitfalls and one-sided provisions. Our attorneys have developed construction agreements that can be adapted to particular projects and, more importantly, the industry member being represented.
