Conn Kavanaugh regularly advises executives and employers on the negotiation and drafting of executive and key-person employment agreements and related incentive compensation agreements. We also have extensive experience in advising clients in connection with negotiating all aspects of separation from employment.

Representative Matters

  • We represented another Fortune 500 client that had learned that two senior sales executives subject to non-competition agreements with access to substantial amounts of confidential and proprietary information had accepted senior positions with a direct competitor. We succeeded in obtaining a court order preventing the former executives from working for the competitor for one year, and ultimately in recovering substantially all of our client's attorney's fees.

  • The firm has represented numerous executives, from middle managers to chief executive officers at publicly traded companies, in the negotiation of their severance packages. The representation typically includes advising executives as to their legal rights on termination and litigating applicable claims as necessary, counseling executives with respect to stock options and pension or other retirement benefits, and addressing non-competition and confidentiality issues.
