Conn Kavanaugh's lawyers have been representing land owners and developers for four decades in maneuvering through the labyrinth of local and state land use and environmental regulations. Our experience is reflected in the work of our real estate transactional practitioners and our land use specialists.
Our lawyers know how to manage and analyze complex transactional matters and administrative cases, both at the local municipal level and at the state level. And, where an appeal or challenge is headed to court, our land use litigators are more than ready. Our experience covers all stages of planning and developing commercial and residential projects, including single-family residential subdivisions, multi-family cluster developments, retail developments, office parks, assisted living facilities, and planned-unit developments. We apply our knowledge -- gained as litigators, negotiators, and transactional counsel -- to marshal engineers and design professionals to work through federal, state and municipal laws, regulations, and rules. Our attorneys have an extensive background in municipal law, having served as counsel for various municipalities and on municipal boards that make land use decisions. Building Department Permitting Many owners and developers are comfortable with procuring basic building permits. However, Conn Kavanaugh can assist in securing complex, controversial, or contested permits for commercial and industrial real estate developments. Even "as of right" projects can be stymied by inefficient or ineffective interactions with building departments and inspectional services departments. Or, some larger projects simply need the additional resources that Conn Kavanaugh can apply to the task. Zoning Applications Conn Kavanaugh has a wealth of experience in analyzing zoning by-laws and in representing clients before zoning and planning boards. We have been called upon to interpret by-laws hundreds of times, and even to draft by-laws when a project requires help from town meeting or city council. Our lawyers can handle any approach to town zoning boards, working with design professionals and clients to formulate just the right pitch. Subdivision Approvals Conn Kavanaugh represents developers before municipal planning boards. We work closely with engineers, surveyors, and clients to formulate plans that will pass muster with even the toughest board. Our experience before planning boards can result in fewer night hearings, where time is money. Wetlands Applications Conn Kavanaugh represents clients in connection with notices filed with local conservation commissions and the DEP. While engineers and botanists are key to staking out a strong position, careful legal counsel is essential to formulating strategy and building the case before commissions and the DEP. Dover Amendment Applications Conn Kavanaugh has given advice to clients in connection with land use applications subject to the so-called Dover Amendment; for example, educational or religious uses. Pursuing such applications -- arguably as of right, oftentimes controversial -- requires a skillful combination of legal analysis and subtle persuasion. Municipalities Conn Kavanaugh's lawyers currently serve and formerly served as town counsel and special town counsel to a number of municipalities, including the state's largest town. Prior representation of towns and service on land use boards give our lawyers special insight into the most effective approaches to land use issues. Appeals Conn Kavanaugh's lawyers have been involved in dozens of successful court appeals of land use decisions -- zoning, subdivision, ANR, wetlands, health regulations, and telecommunications. This experience in formulating case strategy and actually trying cases is invaluable to an efficient and effective case outcome.
