Conn Kavanaugh's trial attorneys have extensive experience in handling a wide variety of professional liability claims. Our lawyers are accomplished in defending claims against attorneys, design and engineering professionals, health care providers, insurance agents and brokers, and other professionals.
In addition, we represent these professionals before licensing, regulatory , and disciplinary boards. Through membership in and leadership of national, state and local organizations devoted to professional liability matters, Conn Kavanaugh's lawyers stay abreast of current trends in the law. The firm's attorneys have litigated a large number of professional malpractice cases to verdict, and we have negotiated favorable settlements in many others. We also have enjoyed considerable success in obtaining the dismissal of such claims in advance of trial. Additionally, our lawyers are well prepared to respond to (or, if appropriate, to resist) subpoenas and discovery requests. We endeavor to narrow requests that are over-broad or abusive, to protect information that is proprietary or confidential, and to minimize the burden on our clients of responding to such requests. We are very familiar with the reporting and litigation budget requirements of insurance carriers, and are accustomed to working closely with claim representatives to achieve the best and most economical results possible. To ensure that cases are resolved as expeditiously and economically as possible, we are adept at using sophisticated litigatio n support and trial presentation technology to enhance the quality and cost-effectiveness of our advocacy. Defense of AttorneysWe have considerable experience defending lawyers against claims of negligence, breach of fiduciary duty, violations of the Massachusetts Consumer Protection Act, and other charges of wrongdoing. The firm's attorneys have tried numerous legal malpractice claims to verdict, and in a number of other cases have reached favorable, entirely confidential settlements after commencing trial. This wealth of trial experience results in more efficient and focused trial preparation. Our familiarity with the substantive law of legal malpractice also has resulted in a successful record with respect to dispositive motions. The firm's attorneys also represent lawyers in connection with disciplinary matters initiated by the Massachusetts Board of Bar Overseers, the agency that disciplines lawyers in Massachusetts. Defense of Health Care ProfessionalsConn Kavanaugh is preferred defense counsel for a number of prominent insurance and health care companies in the defense of health care workers, podiatrists, and nursing homes. We have successfully defended hundreds of claims of malpractice and deceptive trade practices in this area. In the last few years, the firm's attorneys have litigated five such malpractice claims to defense verdicts. We also have mediated and negotiated favorable settlements in many other cases. Many of these claims have involved sensitive and complex issues, such as sexual assaults on patients and critical injuries to newborns. On numerous occasions we have conducted pre-suit investigations and interviews that resulted in an expeditious and efficient resolution of a claim. In addition, we have identified and developed working relationships with some of the preeminent experts in this area within Massachusetts. Furthermore, our staff of attorneys and paralegals are experienced and efficient in the review of medical records, which is a significant aspect in the successful defense of such claims. The firm's lawyers also have successfully represented health care professionals before various licensing boards, and we are intimately familiar with the administrative rules and regulations in this area. Defense of Insurance Agents and BrokersThe firm's trial lawyers have represented insurance agents and brokers in a number of cases involving claims of negligence, breach of contract, and violations of the Massachusetts Consumer Protection Act. In each case, the firm has worked closely with the client agency and the agency's staff to identify all relevant documents and communications and any potentially applicable defenses to liability. Further, in those cases where the agency's exposure largely has been dependent on the outcome of underlying litigation brought against the agency's customers, the firm's attorneys have closely monitored the underlying litigation and on occasion have worked to resolve that litigation in a way that has minimized exposure to our client. Conn Kavanaugh also acts as national counsel for a large insurance company on out-of-state cases involving large exposures or complex coverage issues.
