A cornerstone of Conn Kavanaugh's practice is the defense of complex tort and personal injury claims, including product liability, medical device litigation , mass/toxic torts and business torts. Our clients or their insurers engage us for this purpose.

The more serious and involved the matter, the more likely that clients call on our attorneys to handle every aspect of a demanding assignment. Our experience, diligence, and toughness have led to positive results at every stage of a case: analysis, discovery, negotiation, alternative dispute resolution, trial, and appeal. While many cases are resolved short of trial, our attorneys are recognized in the state and federal courts as lawyers who will try a case to verdict when necessary. Our partners include the past president of the Massachusetts Defense Lawyers Association, and current members of the International Association of Defense Counsel, and Fellows of the American College of Trial Lawyers.

General, Commercial, and Personal Liability

Many carriers and self-insureds call upon Conn Kavanaugh to handle general, commercial, and personal liability claims. Our size permits us to litigate any suit, no matter the magnitude or complexity, with appropriate staffing. We defend large businesses in premises and product liability suits, and individual homeowners for both personal and premises liability claims. While certain cases involve straightforward personal injury claims, others include wrongful death and serious and complicated economic loss. We are familiar with, and regularly utilize, outside expert consultants in various medical and scientific fields to optimize results for our clients. Additionally, we are seasoned at pursuing or defending the range of business tort actions that can arise, such as interference with a contractual relationship, nuisance, and lost profit claims.

Health Care

We have extensive experience in defending providers of health care of all kinds both in civil lawsuits and in regulatory inquiries. Some of this experience is described in the Professional Liability section.

Subrogation

Over the years Conn Kavanaugh both has defended and prosecuted subrogation matters, most of which involve large property damage losses. These cases often require the use of highly technical experts to advance or defend a liability claim, as well as appropriate analysis of property damage/valuation issues. In addition to traditional subrogation cases, Conn Kavanaugh also commonly represents parties seeking to enforce contribution, indemnity, or right to defense claims, including clients outside the insurance industry.
